Tenancy Agreements

Most of the tenancies we deal with at Fairview Property are Short Assured Tenancies, and these are governed by a Short Assured Tenancy (SAT) Agreement which lasts for a minimum period of 6 months.

Generally a Short Assured Tenancy is used where the following conditions are met:

1. The tenancy started after 2nd January 1989, and
2. The property is used as the tenant’s home, and
3. It is their only or main home, and
4. An AT5 Form has been issued, and
5. The tenancy is for a minimum period of 6 moths.

The SAT Agreement is designed to create a Short Assured Tenancy which guarantees a Landlord recovery of possession at the end of the tenancy, subject  to the correct formalities being met to establish and terminate the tenancy. By law, tenants must be provided with a Tenancy Agreement and this must be supplied free of charge.

A special notice, Notice AT5, is given to each prospective tenant prior to the creation of the tenancy, stating that the tenancy being offered is a Short Assured Tenancy.

The Fairview Property tenancy agreement is professionally written and approved by Edinburgh City Council. The agreement is continually updated to comply with new legislation. The detailed nature of the individual clauses is a result of years of experience in the lettings business.
